What is a differential billing?
A differential billing is a charge a distribution utility such as MERALCO issues when it claims that electricity was used but not properly recorded or paid for, often after an inspection finds a tampered meter, an illegal connection, or a meter that did not register correctly. The amount can cover many months and often runs into tens or hundreds of thousands of pesos.
These assessments are governed mainly by Republic Act No. 7832 (the Anti-Electricity and Electric Transmission Lines/Materials Pilferage Act of 1994) and by the rules of the Energy Regulatory Commission (ERC). A differential billing is a claim, not a final judgment. You have the right to question how it was found and how it was computed.

Can they disconnect you right away?
Under R.A. 7832, the discovery of certain circumstances during an inspection can be treated as prima facie evidence of illegal use of electricity. The law allows immediate disconnection on that basis only when the discovery is personally witnessed and attested to by an officer of the law or an authorized representative of the regulator. The Supreme Court has repeatedly treated this requirement seriously.
Practical point: If an inspection happens at your property, ask who the inspectors are, whether a law officer or authorized representative is present, and for a copy of the inspection report. Do not sign a document you disagree with without writing down your objection.
How the process usually works
- Review the notice and the inspection report. We check who conducted the inspection, what was found, who witnessed it, and how the billing period and amount were computed.
- Written protest to the utility. In many cases a formal written dispute, with supporting documents, is the first step and creates a record.
- Complaint before the ERC. If the dispute is not resolved, a complaint can be filed with the Energy Regulatory Commission. Depending on the facts, interim relief may be requested to keep service connected while the complaint is heard.
- Hearings and evidence. Both sides present documents, meter test results, and witnesses.
- Decision and further remedies. ERC decisions may be reviewed through the remedies allowed by its rules and by the courts.
